Department Outreach

08/03/16 - Debra Rudd, Real Estate Appraisal Division Manager, has been invited to be a member of the State Disaster Housing Task Force (SDHTF).  This task force met on August 3rd, 2016 to discuss what each of the thirteen invited attendees could offer in the way of resources to assist the housing recovery, should a disaster occur in our state.  Thom Higinbotham of the Arizona Department of Emergency and Military Affairs explained the interagency disaster planning efforts that have already been underway.  He reported the various needs for housing should a disaster occur, and how consideration must meet the needs of the whole community including those with disabilities.  Other members of SDHTF include representatives from the Registrar of Contractors, Department of Insurance, Department of Real Estate, Department of Housing, Department of Veteran’s Services, Pinal County Emergency Management, Habitat for Humanity, Arizona Housing Alliance, Ability 360, Arizona VOAD and the American Red Cross.  SDHTF will meet again in February 2017 to continue the discussion as a resource center to assist with statewide disaster housing recovery if needed.

7/26/16 - Richard Fergus, Financial Enterprise Licensing Division Manager, and Debra Rudd, Real Estate Appraisal Division Manager, spoke at the Arizona School of Real Estate and Business 2016 Instructor Legislative Update workshop. The purpose of this workshop was to provide legislative updates to the fifty instructors regarding 2016 changes in the real estate industry. They reported on the number of mortgage and appraiser licenses currently held in our state, how many new applications we are receiving, and how long it is taking to process a typical application   Additionally, they reported on the number of complaints received and processed in the past fiscal year, and what we thought might be of benefit for the instructors to pass on to their students.

07/19/2016-07/21/2016 – Tamilee Smull, Financial Institution Division Manager attended the 2016 District V meeting in San Francisco, California.


07/10/16-07/11/16 - Debra Rudd, Manager of the Real Estate Appraisal Division for the Department, spoke at the Collateral Risk Network (CRN) Meeting held in Baltimore, MD.  Approximately 75 members of CRN attended the meetings.  As the President Elect, Ms. Rudd was invited to speak to update the attendees on the activities of the Association of Appraiser Regulatory Officials (AARO).  She reported that AARO has asked for a definition of federally related transactions as shown in the Interagency Guidelines, as there is now confusion, between Dodd-Frank’s “covered transactions” and Interagency Guidelines regarding when appraisals are required and when evaluation can be completed.  Clarity is necessary for those participating states who must have their regulations in place by August 10th, 2018.  To date, 40 of the states have AMC statutes in place, another seven have legislation in process, and three are yet to decide whether to opt in or out of regulation.    More discussions of AMC Final Rules will be taking place at AARO’s Fall Conference to be held in Washington, D.C. October 21st – 24th, 2016. AARO is celebrating its 25th year as an organization for state appraisal program regulators.

06/13/16-06/17/16 – Tammy Seto, Consumer Affairs and MSB’s Division Manager and Ron Doba Financial Services Division manager attended the 2016 NACCA Annual Meeting and Regulators’ Training Symposium.   The keynote speaker for this event was Richard Cordray, Director, Consumer Financial Protection Bureau.  Some of the other expert speakers’ topics included, CFPB Small Dollar Lending, Payday and Small Dollar Lending Program, Marketplace Lending,  A New Tool to Help Fight Fraud, Trending in Lending: Emerging Loan Products,  Nuts and Bolts of Military Lending Action, Things you need to know about Debt Collection, The History of Consumer Credit, Cyber Crime, the 36% question, and the Best and Worst of Examinations.


06/12/16 - 06/14/16 – Tamilee Smull, Financial Institution Division Manager was guest speaker at the Arizona Banker’s Association 113th Annual Convention & Meeting in Sedona, Arizona where she spoke about the state of the state’s financial industry for Arizona.   Some of the other expert speaker’s subjects included Thriving in an Era of Digital Disruption-FINTECH, Real Estate, Election Report, Interest Rate Sensitivity, Chip technology, Preparing your Bank for a Transaction – as Buyer of Seller, Cyber Liability, Washington Update, Volatility: Opportunities and Challenges for Banks in a Fast-Changing Economic Environment and Current Global Economic Cycle & Trends for 2016.

04/08/16- 04/10/16 - Debra Rudd, Appraisal Division Manager attended the AARO Spring Conference held in Phoenix. There were 176 attendees from 39 states who listened to experts on AMC legislation, differences between Appraisals and Evaluations, and Customary & Reasonable Fee Surveys to name a few. The AARO Conference followed The Appraisal Foundation Appraisal Qualifications Board meeting also held at the same location on the morning of April 8th. There were over 200 attendees at this meeting, where alternative experience criteria was considered to become an Appraiser. The meeting was in the response to several questions about whether there will be a future shortage of Appraisers, and whether the AQB 2015 Criteria was too restrictive to attract new Appraiser Trainees to the industry.

04/07/16 - The Society of Chief Appraisers in conjunction with the Arizona Chapter of the Risk Management Association, held a meeting at the office of the Department of Financial Institutions. Approximately 50 attendees listened to local experts on the valuation of environmentally impacted properties, and new apartment projects in the Phoenix market area. Robert Parson, OCC; Ronald Pavlick, Federal Bank Reserve; and Richard Rawson, FDIC spoke about the appraisal responsibilities of the lenders. Tami Smull, Financial Institutions Division Manager, and Debra Rudd, Appraisal Division Manager spoke on the importance of appraisals to the lenders, and about each of their Divisions responsibilities.

04/05/16 - 04/06/16 – Tamilee Smull, Financial Institutions Division Manager attended the CSBS Government Relations Fly-In in Washington DC. Sixty-three state regulators from 39 states attended. Attendees met with the Federal Reserve Board Chief of Staff, and with representatives of their home state delegations. Other speakers included ABA President and CEO Rob Nichols, political analysts, and FinTech experts.  

03/11/16 - Steve McElwain, Financial Enterprise Examiner attended and participated in a regulatory roundtable which also included an examiner from Idaho and Nevada at the Commercial Collection Agencies of America Spring Conference held March 10 -12, 2016 in San Antonio, Texas. The roundtable addressed current issues, specific regulations and state laws which affect collection professionals involved in the collection of commercial debt. There was a question and answer session afterward that included questions concerning licensing requirements, as well as concerns and questions in regards to Arizona converting to NMLS registration for collection agencies. In addition, questions regarding what the Department’s definition of “conducting business” constituted in the state of Arizona and if Arizona differentiated between consumer debt and commercial debt were additional topics of concern that were discussed with the attending collection agency representatives.

02/17/16 –The Arizona Department of Financial Institutions and Arizona Bankers Association held a “Meet Your Regulator” event in the Executive Tower of the State Capitol.  Presenters were from the FDIC, CFPB, FRB, OCC and AZDFI.  Interim Superintendent Robert Charlton, Financial Institutions Manager Tamilee Smull, Legislative Liaison Stephen Briggs and Appraisal Manager Debra Rudd attended this meeting.   There were approximately 40 community and national bankers in attendance.

2/16/16- Interim Superintendent Robert Charlton gave the “Welcome to Phoenix” remarks at the NMLS Annual Conference held at the Pointe Hilton Tapatio Cliffs Resort in Phoenix, Arizona. Licensing Manager Richard Fergus, Licensing Supervisor Latasha Ontiveros, License Maintenance Supervisor Michelle Castaneda and IT Manager Susan Zimmerman attended the conference. The conference was held from February 16 to February 19, 2016 with approximately 640 mortgage, money service business, consumer finance and debt collection/debt management/debt settlement professionals in attendance. Some of the subjects on the conference agenda included trends in consumer lending, the electronic surety bond process, best practices for record maintenance, account administration, and virtual currency.

01/05/15 - 01/07/2015 – Financial Institutions Manager Tamilee Smull attended the CSBS District V/Western Regulators Meeting held at the FRB in San Francisco. This semi-annual meeting focused on commercial real estate concentrations, regulatory burden, bank secrecy act and cyber security, The meeting also includes the 9 western states in the FDIC region which are part of the Conference of State Bank Supervisors. Among those present were the Regional staff members of the FRB, FDIC, CFPB and the OCC.  

12/11/15- AZDFI Tamilee Smull, Financial Institutions Manager, Stephen Briggs Legislative Liaison, and IT Examiner Francisco Rodriguez delivered the Executive Leadership of Cybersecurity (ELOC) seminar sponsored by CSBS in Phoenix.  The ELOC seminar is designed for CEO’s and senior executives to address the issues of cyber security within the financial services industry.  The program provided a non-technical overview of current and anticipated cyber threats to the financial services industry, shared cyber intelligence resources available and best practices the industry should use to mitigate and manage evolving cyber threats.  Officials from the United States Secret Service, Federal Deposit Insurance Corporation and Financial Services Information Sharing & Analysis  Center  discussed the topics of “Globalization of Cybercrime”, “Regulatory Response & the FFIEC Cybersecurity Assessment Tool”, and “Threat Intelligence - Collection and Sharing”, respectively. Also, AZDFI Examiner Rodriguez shared information regarding the Best Practices for Senior Executives and Board Members to manage cybersecurity risk. Approximately three dozen bank and credit union executives attended the seminar, as well as Paul Hickman, President, AZ Bankers Association; Mark Robey, Executive Vice President, Mountain West Credit Union Association; and Lucy Ito, President of NASCUS.

12/09/15-12/11/15 Tamilee Smull, Financial Institutions Manager and Stephen Briggs, Legislative Liaison attended CSBS Supervisors Symposium held in Phoenix Arizona.  The symposium combines state regulators with their federal regulator counterparts to compare industry successes and concerns.  Topics included a panel discussion from bankers who have piloted the FFIEC Cybersecurity Risk Assessment Tool, Economic and Political Outlook for 2016, the rollout and implementation of the Examination Tools Software in 2016 and CSBS accreditation program modernization roadmap.  Approximately 110 bankers and state regulators attended the symposium.

10/16/15-10/19/15 - Debra Rudd, Real Estate Appraisal Manager, attended and was a speaker at the Association of Appraiser Regulatory Officials (AARO) 24th Annual Fall Conference in Washington DC. Ms. Rudd spoke on the merits of consolidating the Board of Appraisal into DFI.   Approximately 176  Appraisal professionals attended the conference.   Some of the other subjects of the conference consisted of possible easing of federal requirements to become an appraiser to address a possible future appraiser shortage by offering alternative experience requirements; and  final rules implementation dates for Appraisal Management Companies.  Mr. Rudd was elected President-Elect for AARO.    The Spring AARO Conference will be held in Phoenix on April 7, 2016 – April 10, 2016.

10/14/2015 - Richard Fergus, Financial Enterprise Licensing Division Manager was guest speaker at the Arizona Association of Mortgage Professionals (AzAMP) Central Chapter monthly meeting.   There were approximately 48 mortgage professionals in attendance.  Mr. Fergus spoke about AZDFI which included licensing and renewal information for mortgage brokers, mortgage bankers and loan originators.

10/02/2015 - Robert D. Charlton, Financial Enterprise Manager, spoke to a group of approximately fifty collection industry professionals at the Arizona Collectors Association 2015 Annual Meeting.    Mr. Charlton spoke about AZDFI and in particular the Department’s regulation and supervision of collection agencies licensed in this state.  Topics discussed were common examination findings and in particular trust account administration and collection practices.  Also discussed were the types of examinations conducted by AZDFI, joint state examinations, and examinations and the Department’s interaction with the Consumer Financial Protection Bureau (CFPB).

09/30/2015 - Richard Fergus, Financial Enterprise Licensing Division Manager was guest speaker for the monthly Fix and Flip Group’s meeting.  The Fix and Flip Group is a subgroup of AZREIA (Arizona Real Estate Investors Association).  The topic was “What you need to know to be a private lender or to borrow from a private lender”.  I talked about licensing requirements for private lenders.  There were 60 registered to attend the meeting.  Attendees included private investors, real estate agents and loan originators.

09/20/15 - 09/22/15 - Superintendent Lauren Kingry of AZDFI and SLC, the State Liaison Committee of the FFIEC, attended the Federal Financial Institution Examination Council meeting in Washington DC.   The FFIEC is a formal inter-agency body empowered to prescribe uniform principles, standards, and report forms for the federal examination of financial institutions by the Board of Governors of the FRB, FDIC, NCUA, OCC, State Regulators, and the CFPB.  Mr. Kingry is the Chairman of the SLC and is a voting member of the FFIEC, in Washington, DC.


09/18/15 - Superintendent Lauren Kingry and Debra Rudd, Real Estate Appraisal Manager, attended the REASA/SCAI meeting, in Tucson. The purpose of the meeting was to introduce the Superintendent to the appraisers in this region. It was also to explain the changes made to the processing of complaints, as well as licensing, since the consolidation in July 2015. They updated the attendees on the number of applications processed for appraisers, appraisal management companies, property tax agents and course providers, and the average number of days it took to process them.

 

09/17/15 – Robert D. Charlton, Financial Enterprise Manager spoke to a group of approximately one hundred Title and Escrow, Bank, and Mortgage professionals at the 2015 Annual Convention for the Land Title Association of Arizona at the High Country Conference Center, Flagstaff, Arizona.  Mr. Charlton spoke about AZDFI which included who the Department regulates and the numbers, how many complaints and the type of complaints the Department receives, common examination violations, various regulatory alerts dealing with mortgage fraud, loan originator and their licensing requirements, loan modifications, the neutral role escrow agents must play, the substantive policy statement the Department has issued on the semi-annual business activity reports for escrow agents, the Anti-Inducement Substantive Policy Statement, ARS 6-161 which allows the Department to remove unfit escrow personnel from the industry, and finally the working relationship between AZDFI, CFPB, AG’s office and other state regulators.

 

09/17/1509/17/15 – Superintendent Lauren Kingry moderated for the RMA lending panel held in Phoenix at the Arizona Country Club chapter meeting.  Discussions focused on lending structure, credit protection, regulation costs, Dodd-Frank and attracting young talent to banking careers.

09/16-09/17/15 – Debra Rudd, Real Estate Appraisal Manager served as a panelist for the Five Star Conference - National Appraisal Congress (NAC) in Dallas Texas to foster dialogue with state regulators dealing with some of the issues involving training and best practices for new appraisers. In particular, NAC is promoting a quicker way for those interested to enter the appraiser profession.

 

09/14-09/15/15 - Tamilee Smull, Financial Institutions Manager attended the CSBS-FDIC De Novo Bank Application Training at the FDIC Regional Office in Dallas, Texas. There were 69 participants from 29 states/agencies in attendance at the training.  The training addressed the application process, decision criteria for evaluating applications, post-approval supervisory strategy, and other supervisory considerations.

 

08/29/15 -09/4/15 - Superintendent Lauren Kingry attended the CSBS Board of Directors and Strategic Planning meeting in Brewster, Massachusetts.  Voting items in the board meeting included: an update to the conflict of interest policy, changes to the SRR budget, model state law for examining services providers, final model regulatory framework for virtual currency activities, non-depository supervision governance task force report, and a recommendation for complaint information sharing.

 

08/24/15 – 09/06/15 - Superintendent Lauren Kingry attended the Western Regulators Meeting held at the FDIC regional offices in San Francisco. This meeting focused on economic and banking conditions, cyber security awareness and cyber tools.  The Superintendent was on a panel with other state Commissioners regarding state regulatory issues and Federal regulatory relationships.  The meeting also included the 10 western states in the FDIC region which are part of the Conference of State Bank Supervisors.  Among those present were the regional staff  members of the CSBS, FDIC, CFPB, OCC and the FRB.

 

08/17/15 - 08/21/15 – Financial Institutions Manager Tamilee Smull attended the FFIEC Fraud Investigation Techniques for Examiners course in Arlington, VA.  The course is to designed for people with some fraud investigation experience to further enhance their skill in interviewing, investigation, documentation, tracing, and case management.

 

07/15/2015 - AZDFI conducted a town hall meeting for the Arizona community bankers to gather and discuss the challenges and opportunities that community banks face in light of the rapidly changing federal regulations.  Executives from the Arizona State Chartered banks joined Superintendent Lauren Kingry, Division Manager Tamilee Smull, at the meeting.  The town hall was held, in part, as preparation for the upcoming Community Banking in the 21st Century Research Conference, to be held in St. Louis on September 30 through October 1, 2015.

 

6/16/15 - Superintendent Lauren W. Kingry attended an educational workshop hosted by the Federal Deposit Insurance Corporation in Nogales Arizona.  Some of the topics included banking relationships with cross border activities and the resulting regulatory expectations, including Bank Secrecy Act/Anti-Money Laundering (BSA/AML) customer due diligence and monitoring requirements, along with discussions of variances between isolated BSA recommendations or violations, pillar violations and systemic program weaknesses.   The workshop was attend by member bankers, federal and state regulators, members from the Ambos Nogales Hispanic Chamber of Commerce and outreach staff from the offices of U.S. Senators and Representative for Arizona.

 

6/8/15 - Superintendent Kingry gave the State of the State’s address at the 112th Annual Convention and Meeting held in Marana, Arizona presented by the Arizona Bankers Association. A message of continued improvement in the Az banks was delivered by the Superintendent. 

 

6/01/15 - 6/05/15 - Robert D. Charlton, Assistant Superintendent and Financial Enterprise Division Manager attended the National Association of Consumer Credit Administrators 80th Annual Meeting and Regulators’ Training Symposium in Atlanta, Georgia.   This annual meeting is attended by state regulators from all over the country that focus on non-depository licensees.  Discussions were held regarding common issues taking place in various states, speakers from the Consumer Financial Protection Bureau (CFPB) provide federal updates, National Mortgage Licensing System (NMLS) speakers discuss their system, small dollar credit discussions, student lending issues, and finally, joint meetings were held with industry members of the American Financial Services Association (AFSA) and the Financial Services Centers of America (CFSA). The conference provides an excellent opportunity for regulators and private businesses to work together to address common issues that impact consumers, states and the companies that offer financial services.

 

05/27/15 - 05/29/15 - Superintendent Kingry attended the CSBS State-Federal Supervisory Forum in San Francisco, California.  Some of the presentations  included agricultural asset values: monitoring and stress testing, CSBS government relations updates and emerging trends and risks in commercial real estate.   In addition to the States Only portion of the Forum, all the Federal Banking counterparts were present to discuss mutual banking concerns and success.  At this meeting, CSBS announced its 2015-2016 Board and Officers which includes the installment of Superintendent Kingry as Vice Chairman of the Executive Committee.  See the CSBS Media Release.

 

04/12/15 - 04/15/15 - Superintendent Lauren Kingry joined the CSBS Executive Committee in Washington D.C. for its semi-annual meeting with FDIC Chairman Gruenberg, Doreen Eberley, and Mark Pearce.  The Committee also had meetings with the Federal Reserve Board Governors Tarullo, Powell, and Brainard.  The Executive Committee held its regular monthly call to receive updates from staff on various initiatives.

 

04/09/15 – Superintendent Lauren Kingry, Assistant Superintendent Financial Services Division Bob Charlton, and Licensing Manager Richard Fergus hosted a meeting with the Arizona Mortgage Lenders Association (AMLA) and Arizona Department of Real Estate (ADRE) to provide an industry update, discuss current topics, and hold a questions and answers session. 

 

03/29/15 -04/01/15 - Superintendent Lauren Kingry attended the Federal Financial Institutions Examination Council (FFIEC) meeting and SLC Briefing in Washington DC where he was reappointed to a two-year term on the SLC which will continue through March 31, 2017.  If you would like more information, see the press release here.

- Superintendent Lauren Kingry attended a private roundtable in Nogales hosted by the FDIC to hear directly from local small businesses regarding their banking experiences, including deposit and borrowing relationships with insured depository institutions.

- Tamilee Smull, Financial Institutions Division Manager and Craig Raby, Assistant Attorney General joined State Credit Union Regulators from 37 other states at the 2015 NASCUS/NCUA National Regulators Conference.  The state regulators meet annually with the National Credit Union Administration Board Members and Regional Leaders to discuss current risks and legislative changes that are impacting the Credit Union industry.  During the Conference, Ms. Smull also participated in a joint session of the Performance Standards Committees for NASCUS and the Conference of State Bank Supervisors (CSBS) to develop efficiencies in a combined CSBS/NASCUS state regulators’ accreditation review process.

- Superintendent Lauren Kingry attended the CSBS Government Relations Fly-in, Board Meeting, CSBS Education Foundation Meeting, and New Commissioner Briefing held in Washington DC.  Approximately seventy state regulators representing forty state agencies were in attendance.  The attendees brought their “outside the beltway” perspective and experience to discuss and advocate to Members of Congress, federal regulators, and their staff on issues affecting community banks and other financial services issues.

- Richard Fergus, Licensing Division Manager, and Michelle Castaneda, Licensing Supervisor for Financial Enterprises attended the annual NMLS Conference held in San Diego.  There were over 550 regulators and industry representatives in attendance from all over the U.S., including Puerto Rico.  Individual sessions were held during the conference addressing changes and the use of NMLS and those industries using NMLS (including the money service business, consumer lenders and the mortgage industry).

01/21/15–01/23/15 - Tamilee Smull, Financial Institutions Division Manager joined officials from the National Association of State Credit Union Supervisors (NASCUS) to conduct a peer accreditation review for another state credit union regulatory agency.


01/13/15 -01/15/15 - Tamilee Smull, Financial Institution Division Manager joined more than two dozen state regulators at the CSBS District V meeting at the Federal Reserve Bank of San Francisco.  State banking regulators from seven western states met to discuss industry trends and current safety and soundness concerns.  The state authorities were joined by Federal Reserve Bank, FDIC, CFPB and OCC officials to discuss community banking industry challenges, including regulatory burden, streamlined payment systems and consumer compliance.

 

12/08/14 -12/12/14 - Superintendent Lauren Kingry attended the CSBS Board Meeting & Supervisors Symposium held in Washington DC.  Mr. Kingry is current a member of the Executive Committee for the CSBS Board and serves as the Treasure for the Board and the affiliated subsidiaries to CSBS.  The Symposium combines States Regulators with their Federal Regulator counterparts to compare industry successes and concerns.  Topics included interest rate risk, cybersecurity, loan quality in banks, and de novo banking applications.

 

12/5/14 - Tamilee Smull, Financial Institutions Division Manager attended the first of five outreach meetings held by Federal Banking Regulators in Los Angeles.  The meetings are being held as part of the 10 year review of federal regulations under the EGRPRA efforts to modernize banking regulations by eliminating unnecessary or over-burdensome regulations.  Bankers and other interested persons may respond to requests for feedback regarding the EGRPRA efforts.

 

12/2/14 -12/4/2014 - Superintendent Lauren Kingry attend the FFIEC meeting and SLC Briefing held in Washington DC.  Mr. Kingry is a member of the State Liaison Committee representing the States Regulators across the country.  Topics included Cybersecurity in our financial institutions, updates Federal Appraisal Subcommittee, and discussions around outdated and unnecessary Federal banking regulation.

11/25/14 - The first of a series of meetings to adhere to the Economic Growth and Regulatory Paperwork Reduction Act of 1996 (EGRPRA) which requires that regulations prescribed by the Federal Financial Institutions Examination Council, Office of the Comptroller of the Currency, Federal Deposit Insurance Corporation, and Board of Governors of the Federal Reserve System be reviewed by the agencies at least once every 10 years will be held on December 2, 2014 at the Los Angeles Branch of the Federal Reserve Bank of San Francisco.  For more information, please see the joint press release issued on November 5, 2014 at http://www.federalreserve.gov/newsevents/press/bcreg/20141105b.htm


10/6/14-10/8/14 - Superintendent Lauren Kingry attended the CSBS Executive Committee meeting in Washington DC.  The Superintendent and other State Banking Supervisor members met with FDIC Chairman Marty Gruenberg  and OCC Director Tom Curry.  In separate meetings the Exec. 09/26/14  – Superintendent Lauren Kingry, Robert Charlton, Financial Enterprise Manager and Legislative Liaison Louis Dettorre attended the Arizona Collectors Association 2014 Annual Meeting in Phoenix, AZ.   Superintendent Kingry was guest speaker.  The topics included emerging issues for collections agencies as well as supervisory comments from the Agency.

 

09/25/14 – Superintendent Lauren Kingry moderated the annual RMA lending panel held at the Arizona Country Club.  Approximately 40 people were in attendance from several industries, including bank lenders.  The panel consisted of four local Chief Lending Officers for banks in Arizona.  The panelists responded to a variety of questions regarding the current lending and regulatory issues in the industry. 

 

09/24/14-09/26/14 - Susan Zimmerman, IT Manager attended the CSBS Technology Seminar & ETS-ALERT Users & Refresher Training.   57 IT managers and examiners from 24 states participated in the annual Seminar.  Topics included IT confessions and dialogues, state IT demos, cybersecurity, IT and business resiliency, NMLS roadmap, FDIC technology roadmap, cloud computing, bring your own devices for workplace mobility and Examination Tool Suite update.

 

09/22/14-09/24/14 - Tamilee Smull, Financial Institutions Division Manager and Arizona Bankers Association President Mike  J. Thorell attended the second annual Community Banking in the 21st Century Research Conference hosted by CSBS and the Federal Reserve.  The second day of the conference featured the release of the 2014 community banking report, which includes results from a national survey of more than 1,000 community bankers from across the country, as well as the summaries of community banker town hall meetings that were hosted by state bank commissioners this spring and summer.

 

09/19/14 - Superintendent Lauren Kingry was guest speaker at the 2014 Mountain West Credit Union Association Economic Summit.  The Superintendent spoke on current issues of opportunity and caution for the industry from a regulators perspective.

 

8/25/14 - Superintendent Lauren Kingry, and Legislative Liaison Louis Dettorre held Association meetings today with representatives from the Arizona Collectors Association and the Arizona Title Loan Association to discuss industry updates and current topics, as well as inquiring of how the Agency was handling the licensing and supervising responsibilities.  Also in attendance from the Agency was Bob Charlton, Financial Services Manager and Richard Fergus, Licensing Manager. 

 

8/18/14 - Superintendent Lauren Kingry, Assistant Superintendent Financial Services Division Bob Charlton, Licensing Manager Richard Fergus, and Legislative Liaison Louis Dettorre held a meeting with representatives from the Land Title Association of Arizona and the Arizona State Escrow Association to provide an industry update and discuss current topics.

 

8/18/14 - Superintendent Lauren Kingry, Legislative Liaison Louis Dettorre and Licensing Manager Richard Fergus held an association meeting with representatives from the Arizona Association of Mortgage Professionals (AzAMP) and Arizona Mortgage Lender’s Association (AMLA) to provide an industry update and discuss current topics.

 

8/04/14 - Superintendent Lauren Kingry and Examiner Gaby Macias attended the 2014 25th Annual American Association of Residential Mortgage Regulator Conference held in Seattle, Washington.  This conference included the State Regulator NMLS meeting and an SRR Board meeting.  The conference focused on mortgage servicing, BSA/AML compliance and CFPB updates.

 

7/22/2014 - 7/24/2014 - Superintendent Lauren Kingry attended the CSBS District V/ Western Regulators Meeting held at the FDIC regional offices in San Francisco.   This semi-annual meeting focused on cyber fraud/security, emerging risks: BSA, compliance, IT and governance in today’s banking environment.  The meeting also includes the 9 western states in the FDIC region which are part of the Conference of State Bank Supervisors.  Among those present were the Regional staff members of the FDIC, CFPB and the OCC.   

 

6/20/14 - AZDFI conducted a town hall meeting for the Arizona community bankers to gather and  discuss the  challenges and opportunities that community banks face in light of the rapidly changing federal regulations.  Executives from the Arizona State Chartered banks  joined AZDFI Superintendent Lauren Kingry, Bank Division Manager Tamilee Smull, and Legislative Liaison Louis Dettorre at the meeting.   The town hall was held, in part, as preparation for the upcoming Community Bank Research Conference, to be held at the St. Louis Federal Reserve Bank in September, 2014.   Arizona was one of many states participating in the town hall meetings – a partnership effort of the CSBS and the Federal Reserve Board to facilitate ongoing communication with community bankers and regulators, regarding the impact of The Dodd-Frank Wall Street Reform and Consumer Protection Act.  

 

6/15/2014 - 6/16/2014 - Lauren Kingry, Superintendent, Robert Charlton, Division Manager and Mark Murphy, Examiner attended the U.S. Mexico Binational Anti-Money Laundering Symposium which brings together Mexico’s federal and U.S. state financial regulatory officials, and financial crime investigators and prosecutors to share experiences and information concerning current trends and best practices in the prevention and disruption of Money laundering activities by transnational criminal organizations held in Tempe Arizona.  Mark Murphy gave a presentation on best practices to enhance and support collaboration among state and federal southwest border area regulators.  Mr. Murphy discussed current issues the state and federal regulators are facing as it relates to money services businesses and an overview of examination trends within the money service business industry.

 

6/10/14 - 6/13/14 - Robert D. Charlton, Assistant Superintendent and Financial Enterprise Division Manager attended the National Association of Consumer Credit Administrators 79th Annual Meeting and Regulators’ Training Symposium in Albuquerque, New Mexico.   This annual meeting is attended by state regulators from all over the country that focus on non-depository licensees. Discussions are held regarding common issues taking place in various states, speakers from the Consumer Financial Protection Bureau (CFPB) provide federal updates, National Mortgage Licensing System (NMLS) speakers discuss their system, small dollar credit discussions, student lending issues, and finally, joint meetings are held with industry members of the American Financial Services Association (AFSA) and the Financial Services Centers of America (CFSA). The conference provides an excellent opportunity for regulators and private businesses to work together to address common issues that impact consumers, states and the companies that offer financial services.

 

6/9/14- Superintendent Lauren Kingry was guest speaker at the Arizona Bankers Association 111th Annual Convention in Sedona, Arizona. Mr. Kingry provided an update on the state of Arizona banking as well as emerging issues which could affect Arizona on the national front.  Bank Presidents and CEO’s were in attendance along with many bank Board Members.

 

5/14/14 - Robert Charlton, Assistant Superintendent and Financial Enterprise Manager was guest speaker at the (AzAMP) Arizona Association of Mortgage Professional’s Central Chapter monthly meeting in Scottsdale, AZ.   There were approximately 60 people in attendance.  Mr. Charlton spoke on the Department statistics, what licenses DFI regulates, loan originator examinations, multi-state examinations, CFPB examinations, E-examinations and common violations found during the examination process.

 

5/11/14 - 5/16/14 - Superintendent Lauren Kingry attended the CSBS State-Federal Supervisory Forum in Chicago, Ill.  At the Symposium key issue were discussed such as Examining the Cyber Threat, Strategies for Success in the 21st Century – Managing a Multi-Generational Workforce, Mortgage Rules, TILA/RESPA disclosures and Crypto-Currency.  Mr. Kingry also accepted his nomination to be the Treasurer for the CSBS organization for the 2014/2015 fiscal year.  All Federal Regulatory Agencies were represented at this Symposium.

 

4/17/14 - Lauren Kingry, Superintendent and Louis Dettorre, Legislative Liaison attended the Arizona Mortgage Lenders Association (“AMLA”) monthly luncheon in Scottsdale. Superintendent Kingry provided an industry, regulatory and legislative update.  

 

4/2/14 - June Beckwith, AZDFI attended the 8th annual Webcast-Financial Literacy Summit 2014 sponsored by the Federal Reserve Bank of Chicago and Visa.   The webcast included two panel discussions; “Bringing Financial Literacy to the Unbanked and Underbanked” and “Reaching the Unbanked and Underbanked with Financial Literacy Resources”. The key goal is to get Financial Literacy taught in all public schools.  A few of the many interesting topics that were discussed: The U.S. Treasury Department is developing A myRA (“My retirement Account”) which is a new program offering a retirement savings account that is a savings bond wrapped in an IRA via payroll deduction and can travel from workplace to workplace so that young people can build a retirement account.  The Treasury Department is also working on a Financial Empowerment Fund, soliciting fun and innovative ideas for young and lower income people to leverage savings.  If you would like to listen to this on-demand webcast, click on the following link: http://www.practicalmoneyskills.com/summit2014/webcast.php

 

3/25/14 - Tamilee Smull, Financial Institutions Division Manager participated at the Western Independent Bankers Annual Conference held in Tucson, Arizona.   Smull joined Federal Regulators and Federal Deposit Insurers on a panel to deliver a Learning Session for Bank Presidents, Senior Officers and Directors. The discussion topics included current concerns such as Cyber-security,  Interest Rate Risk and Industry Consolidation and included a question and answer session.  Other panel members included Laura Fiene, Assistant Regional Director, CFPB; Kathy Moe, Deputy Regional Director, FDIC; Joe Lozano, Vice President, Community Institutions Group, Federal Reserve Bank of San Francisco; Moderator: Bart Smith, Managing Director, Performance Trust Capital Partners, LLC.

 

3/24/14 - Lauren Kingry, Superintendent attended the CSBS Board of Directors meeting in Washington, DC.  Discussion of non-bank mortgage servicers was part of the meeting along with public policy development. The Superintendent also attended an FFIEC State Liaison Committee Meeting while in Washington discussing state participation on the FFIEC taskforces and LAG updates. 

 

3/24/14 - Lauren Kingry, Superintendent and Louis Dettorre, Legislative Liaison attended the CSBS Government Relations Fly-In.  More than 65 state regulators representing over 35 state agencies attend the Fly-in.  In addition to meetings with Federal Reserve Chair Janet Yellen and other Governors, Fly-In attendees heard from FDIC Vice Chair Tom Hoenig, Treasury Under Secretary Mary Miller, and Dan Crippen, the Executive Director of the National Governors’ Association. Other topical panels covered political and regulatory issues and CSBS data initiatives. During the day on the Hill, Fly-In attendees heard from House Financial Services Committee Chairman Jeb Hensarling (R-TX) and Ranking Member Maxine Waters (D-CA), Senate Banking Committee Ranking Member Mike Crapo (R-ID), and Senator Heidi Heitkamp (D-ND). Superintendent Kingry and Mr. Dettorre also met with members of the Arizona Delegation on the Hill. The topic of right-sizing community bank regulation was a common theme of the conference.

 

3/20/14 - Louis Dettorre, Legislative Liaison and Richard Fergus, Licensing Manager hosted a Capitol Day for the Arizona Mortgage Lenders Association (“AMLA”) at the Arizona State Capitol.  The Chair of the House Financial Institutions Committee, Representative Kate Brophy McGee (LD-28) was also in attendance to discuss the legislative process, mortgage related issues, and state compliance with federal regulation.

 

3/10/14 - Tamilee Smull, Financial Institutions Division Manager attended the NASCUS/NCUA Regulators 2014 National Conference in Pittsburg, PA. Smull attended the NASCUS Board meeting and met with other state Credit union Supervisors.  The State Supervisors were then joined by the NCUA Board Members and Regional Executives to discuss regulatory changes affecting credit unions.  The State and Federal Regulatory executives also spent time in breakout sessions to address industry challenges as well as Regional breakouts to discuss important matters identified during joint examinations.

 

3/4/14 - Superintendent Lauren Kingry was a panel member for the 2014 Forum for Community Bank Examiners hosted by the Federal Reserve Bank of Houston that was held from March 4 – 6, 2014 in Dallas, Texas.  The Forum provides community bank examiners with continuing professional development in relevant technical and non-technical skills, all within a dynamic and interactive environment designed to give participants networking opportunities with peers and increase job satisfaction.

 

2/23/2014 – Tamilee Smull, Financial Institutions Division Manager joined Former NASCUS Chairmen, as a member of the performance standards committee to participate in a peer review at another NASCUS accredited state agency.  Smull said “The experience was especially valuable to see how another state accomplishes examinations and addresses risk at credit unions. It also gave me a greater perspective about the differences in statutes and variances in organization structure among the states.  I am really glad to be working in Arizona DFI.”   The peer review is an integral part of the state financial institution supervisors and agency accreditation process.

 

2/6/14 - The Arizona Department of Financial Institutions and the Arizona Banker’s Association jointly organized a briefing held in the Executive Tower of the State Capitol for bankers from around the State.  Diverse supervisory officials in our region provided insight on emerging banking issues including: Superintendent Lauren Kingry, Kathy Moe, FDIC, Edwin Chow, CFPB, Kurt Raney, OCC, and Wallace Young, FRB

 

1/17/14 - Richard Metsger, who recently joined the NCUA Board, toured the western region by visiting with executives from TruWest Credit Union to discuss regulation, regulatory burdens and emerging issues for credit unions.  Superintendent Kingry and Division Manager Tamilee Smull also attended to represent AZDFI.

 

1/14/14- 1/16/14 – Superintendent Lauren Kingry and Division Manager Tamilee Smull attended the CSBS Western Region Regulators Interagency & NASCUS Regional Regulators meeting in San Francisco, California.  The states held a day of round table discussions before joining their federal counterparts for a day and a half of presentations. Some of the topics at the NASCUS roundtable were legislative issues along with bitcoin/digital currency and split dollar/BOLI.

 

1/10/14 - Superintendent Lauren Kingry gave opening remarks for the “Protecting Homeowners” session of the CFPB Briefing on the New Mortgage Servicing Rule event held at the Burton Barr Central Library in Phoenix held by the National Association of Realtors.   Consumer Financial Protection Bureau Director Richard Cordray delivered remarks that primarily focused on the new mortgage servicing rules to protect consumers from risky loan products effective on January 10, 2014.

12/8-12/12/13 - Superintendent Lauren Kingry attended the Conference of State Bank Supervisors Board Meeting and Supervisors Symposium in Washington, DC.  Some of the topics included state’s efforts to improve financial literacy, Bitcoin 101 & policy implications and emerging technology and cyber risks.

12/2-12/4/13 - Superintendent Kingry of AZDFI and SLC of the FFIEC, attended the Federal Financial Institution Examination Council meeting in Washington DC.  The FFIEC is a formal inter-agency body empowered to prescribe uniform principles, standards, and report forms for the federal examination of financial institutions by the Board of Governors of the FRB, FDIC, NCUA, OCC and the CFPB.

 

11/19-11/20/2013 - Superintendent Lauren Kingry attended the Southwest Border Anti-Money Laundering Alliance in Austin Texas.

 

11/19-11/20/13 – Superintendent Lauren Kingry and Mark Murphy, Examiner attended the Southwest Border Anti-Money Laundering Alliance Organization Conference in Austin, Texas.  These meetings are to keep Alliance-affiliated investigators, prosecutors, analysts and all levels of government in touch with each other for all aspects of money laundering between states and countries.  This year Mark Murphy was a guest speaker on the creation and implementation of the Southwest Border Examination Alliance.  Mr. Murphy spoke on why the examination alliance was formed and new best practices to enhance and support collaboration among state and federal southwest border area regulators.  Mr. Murphy discussed the coordination of training for state and federal money transmitter examiners as well as specific goals for the Examination Alliance.  He then followed up with a question and answer session.     

 

11/12/13 – Richard Fergus, Licensing Manager was guest speaker at the monthly meeting of the Arizona Association of Mortgage Professionals (AzAMP) Southern Arizona Chapter.  Mr. Fergus spoke on loan originator licensing, the National Mortgage Licensing System Uniform State Test and the Department’s areas of supervision.  He then followed up with a question and answer session.

 

10/10/13- Superintendent Lauren W. Kingry and Tamilee U. Smull, Bank and Credit Union Manager, are pleased the Federal Financial Regulators and Deposit Insurance Agencies have encouraged institutions to work with borrowers who face temporary hardships due to the federal government shutdown.   The Arizona Department of Financial Institutions agrees with joint agency statement issued by the Board of Governors of the Federal Reserve System, Consumer Financial Protection Bureau, Federal Deposit Insurance Corporation, National Credit Union Association, and Office of the Comptroller of the Currency on October 9, 2013. 

 

Superintendent Kingry stated “During the recent recession and subsequent recovery, many Arizona lenders have successfully assisted their borrowers by granting prudent loan workout arrangements and providing suitable repayment alternatives during trying times.  The current federal government situation is indicative of a natural risk when granting credit that is caused by unexpected change.  The joint agency statement also accentuates the universal importance of the services provided by financial institutions for businesses, communities, and families during times of change and challenge.”

9/20/2013 - Richard Fergus, Licensing Manager attended the AzAMP Arizona Association of Mortgage Professionals’ Fall Expo. The Fall Expo was held September 20 and 21 with a planned attendance of 200 people.  The speaker for the luncheon was Marc Savitt, President of NAIHP (National Association of Independent Housing Professionals).  Mr. Savitt spoke about loan originator compensation and what’s been happening at the CFPB (Consumer Financial Protection Bureau).  The luncheon with Mr. Savitt as its speaker also served as a one hour of continuing education for licensed loan originators.

 

9/19/13- Robert Charlton, Assistant Superintendent & Financial Enterprise Manager was guest speaker at the LTAA (Land Title Association of Arizona’s Annual Convention).  There were approximately 100 people in attendance.  Mr. Charlton spoke about AZDFI which included the license types and growth in various areas, common escrow complaints and violations found on examinations.  Mr. Charlton then fielded questions from the audience.

 

9/10/13-9/13/13 – Superintendent Lauren Kingry attended the CSBS (Conference of State Bank Supervisors) quarterly Board of Directors Meeting in Lexington, Kentucky.  Mr. Kingry is currently Secretary of the Executive Board of Directors for CSBS.  On Monday, the CSBS Education Foundation held a strategic planning session and held focus group meetings with an outside consultant regarding the accreditation program.  On Tuesday, the State Regulatory Registry and Bankers Advisory Board also held meetings.  The CSBS Board met on Wednesday, and the week concluded with a CSBS strategic planning session

9/5/13- Superintendent Lauren Kingry was guest speaker at the annual Arizona Bankers Association Leadership College where he gave the “State of the State’s Financial prospective”.  Mr. Kingry spoke of a general and consistent recovery to the Arizona banking environment.   

 

8/9/13 – Robert Charlton, Financial Enterprise Manager was guest speaker at the Arizona Collectors Association Annual Meeting.  Mr. Charlton spoke on AZDFI, our relationship with the CFPB (Consumer Financial Protection Bureau) and coming violations of collection agencies.   There were approximately 50 collection agents in attendance.

 

8/6/13 – Louis Dettorre, Legislative Liaison and State Representative Kate Brophy McGee (LD-28), Chairman of the House Financial Institutions Committee, hosted the Arizona Mortgage Lenders Association (AMLA) at the Arizona State Capitol to discuss emerging industry issues and the Legislative process.

 

7/30/2013-8/1/2013- Superintendent Lauren Kingry, also CSBS District V Vice Chairman and Tamilee Smull, Financial Institutions manager attended the Western Region Regulator Interagency Meeting and District V Meeting held in San Francisco, California.  Mr. Kingry gave the opening remarks along with Stan Ivie, FDIC, Teresa Curran, FRB, Kay Kowitt, OCC.  Mr. Kingry participated on the State Regulator Panel as moderator discussing economic banking conditions.   Superintendent Kingry also moderated the welcome and introductions for the District V meeting soliciting all representatives of the District V to share success stories and lessons learned, for their states.

 

6/14/13 – Superintendent Lauren Kingry and Louis Dettorre, Legislative Liaison attended the 2013 Arizona Mexico Commission Plenary Session at the Montelucia in Scottsdale. Mr. Kingry presented to the Financial, Business and Legal Services Committee on the topic of Cross-Border Currency and Deposit Regulations.

6/3/13 – Superintendent Lauren Kingry and Louis Dettorre, Legislative Liaison attended the Arizona Bankers Association’s Annual Convention. Mr. Kingry provided the association with a presentation on the “State of the State’s Financial Industry”.

 

5/19/13 – 5/22/13 – Superintendent Lauren Kingry attended the CSBS Supervisors Symposium in Nashville, TN to participate in briefings regarding regulation policy, legislative affairs, bank supervision, consumer protection, professional development and an NMLS update. The new CSBS officers for 2013-2014 were also sworn in at the Symposium. Superintendent Lauren Kingry was elected as Secretary to the Executive Committee of the Conference of State Bank Supervisors for 2012-2013.

 

3/10/13 - 3/14/13- Superintendent Lauren Kingry attended the CSBS Board Meeting and Fly-in to Washington D.C. with over 30 other state banking commissioners. Superintendent Kingry addressed the Chairman of the Federal Reserve, Mr. Ben Bernanke in a closed setting to discuss community banking. The CSBS and Mr. Kingry met with Representatives and staff of the House Committee on Financial Services which includes a member of the Arizona delegation.

 

2/26/13 - The AZDFI and Arizona Bankers Association held the first “Meet Your Regulators” event in the Executive Tower of the State Capitol on February 26th, 2013. Superintendent Lauren Kingry, Kathy Moe, Deputy Regional Director of the Federal Deposit Insurance Corporation, Edwin Chow, Regional Director of the Consumer Financial Protection Bureau, Richard Shershenovich, Jr., Director, Regional and Foreign Institutions Group, Federal Reserve Bank of San Francisco, Los Angeles Branch, and Steven Jacobs, Assistant Deputy Comptroller from the Phoenix Office of the Comptroller of the Currency all gave their take on emerging banking issues. More than fifty bankers from around the State were in attendance.

 

2/26/13 - The AZDFI hosted Edwin Chow, Regional Director of the Consumer Financial Protection Bureau at the Department for a discussion on emerging enterprise issues. Nearly twenty representatives from licensed money transmitter and collection agencies were in attendance.

01/22/13 – 01/24/13- Superintendent Lauren Kingry attended the FRB Western District Interagency Meeting and the CSBS Region V Semi-Annual meeting sponsored by the Bank of San Francisco.  Some of the topics of this meeting included Dodd Frank rulemaking and its effect on community bank supervision, banking conditions, mobile banking and payment issues, internet payday lenders working with tribal communities, and member business loan caps for credit unions.  Superintendent Kingry was elected for a two year term as CSBS Chairman of District V which includes Alaska, Arizona, California, Guam, Hawaii, Idaho, Montana, Nevada, Oregon, Utah, and Washington.


01/08/13 - Superintendent Lauren Kingry and Louis Dettorre, Legislative Liaison attended a 2013 Economic Outlook discussion hosted by the Construction Management Association of America – AZ, The Association of General Contractors – Arizona Branch, and the Arizona Builders’ Alliance. Mr. Kingry sat on a panel that discussed current challenges of economic growth and recovery, condition of banks in Arizona, and the general outlook of the land market

10/11/12 -  Susan Zimmerman -  the Department’s IT manager attended the CSBS Technology Conference in Philadelphia.  The Conference focused on NMLS -  data security and FDIC software solutions.

 

10/05/12 -  Richard Fergus -  Licensing Manager attended the Association of Mortgage Professional’s Industry Expo held at the Phoenix Convention Center.  The Expo featured speaker Mark Savitt -  President of NAIHP and focused on mortgage industry topics.

 

10/02/12 -  Robert Charlton -  Assistant Superintendent was guest speaker at the Arizona Infragard FBI White Collar Crime program held at Wild Horse Pass.  The topics were the Department’s coordination with the Attorney General’s Office -  Consumer Financial Protection Bureau -  Housing and Urban Development -  the Internal Revenue Service -  and the Federal Bureau of Investigations and also mortgage fraud.  Approximately 150 FBI and law enforcement personnel were in attendance.

 

09/20/12 -  Robert Charlton spoke at the Land Title Association Conference in Sedona.  The topics included Department updates -  short sale negotiations and licensure.

09/11/12 -  Superintendent Lauren Kingry and Tamilee Smull -  Financial Institutions Manager held a meeting with the Mountain West Credit Union Association to discuss credit union issues.

 

09/06/12 -  Superintendent Lauren Kingry was a guest speaker at the Joint Women’s Council of Realtors/Southern Arizona Mortgage Lender Association Business Resource Meeting along with Judy Lowe -  Commissioner of the Department of Real Estate and Diana Williams -  National RESPA fraud speaker.

 

08/23/12 -  Superintendent Lauren Kingry -  Louis Dettorre -  Legislative Liaison -  Richard Fergus and Latasha Ontiveros -  licensing management met with the Arizona Automobile Dealers Association to discuss upcoming legislative issues.

 

08/16/12 -  Superintendent Lauren Kingry -  Robert Charlton -  Assistant Superintendent and Louis Dettorre -  Legislative Liaison met with the Land Title Association and the Arizona State Escrow Association to discuss pending legislation and unlicensed activity.

 

08/14/12 -  Richard Fergus -  the Department’s Licensing Manager attended the AARMR 23rd Annual Regulatory Conference in Boston.  General Sessions included mortgage loan servicing -  foreclosure prevention -  loan modification scams.  Speakers included representatives from FinCEN -  CFPB -  NMLS and FHFA.

 

08/13/12 -  Superintendent Lauren Kingry and Robert Charlton -  Assistant Superintendent were guest speakers at the 2012 Annual meeting of the Arizona Collectors Association held in Glendale -  Arizona.

 

08/01/12 -  Superintendent Lauren Kingry was guest speaker at the Real Estate Agent’s meeting held in Phoenix.   Louis Dettorre attended.  The main topics were short sales -  legislation and licensure.

 

07/15/12 -  Superintendent Lauren Kingry and Tamilee Smull attended the NASCUS/CSBS District V Regulator meeting held in San Francisco -  CA.

 

06/23/12 -  Superintendent Kingry was a panel member for the TMA program which includes the federal -  state and local regulation of banks -  lenders and credit unions.
