Attention! Administrative Rules being proposed, your input is encouraged!

The Department of Financial Institutions has prepared proposed administrative rules and has submitted them to the Secretary of State’s office on March 22, 2012.   The rules will be published on April 13, 2012 and the Department will accept written comments and schedule an oral proceeding if requested in writing within 30 days after the publication date under the provisions of  A.R.S. § 41-1023(C).  Comments on the rules or requests for oral proceedings can be submitted to rfergus@azdfi.gov or mailed to Richard Fergus, 2910 N. 44th Street, Suite 310, Phoenix, AZ  85018.

The topics of the proposed rules are all relating to the regulation of the mortgage industry, and all are directly authorized by the recent passage of legislative changes. The three topics are the following:

• Process for the conversion of a mortgage broker license to a commercial mortgage broker license;
• Process for applying for and maintaining a certificate of exemption pursuant to ARS 6-912; and
• Process for the conversion of a mortgage banker license to a mortgage broker license.

Please be advised when reading the proposed rules that new proposed language is underlined. Language not underlined is language that already exists in the administrative rules. The proposed rules can be found HERE.
